1. SANS INCREDIBLE VACATIONS (for brevity’s sake hereinafter referred to as SIV) are Booking Agents for facilitating all Travel Related Services (for brevity’s sake hereinafter referred to as TRS) and/or (for brevity’s sake hereinafter referred to as &/o) Tour Operator/s (for brevity’s sake herein after referred to as TOP/s) &/o Service Provider/s (for brevity’s sake hereinafter referred to as SP/s) for the booking of the Tour as per the bookings attached/overleaf &/o any TRS.
2. BROCHURE / ITINERARY : Information provided in the various Brochure/s &/o specially prepared itinerary (for brevity’s sake hereinafter referred to as BR/s) prepared by the TOP/s &/o SIV is based on information provided by TOP/s &/o SP/s and presented to the Passenger/s (for brevity’s sake hereinafter referred to as PAX/s) are as accurate as possible at the time of it’s preparation. The BR/s Descriptions are of amenities normally provided &/o made available. However these can change due to events beyond the control of TOP/s &/o SP/s &/o SIV. This may require TOP/s &/o SP/s &/o SIV to make changes in the Itineraries. Every efforts is made to avoid any inconvenience to the PAX/s. SIV takes no responsibility for any claim/loss/inconvenience that may be caused by such changes.
3. TRAVEL RELATED DOCUMENT/s : (for brevity’s sake hereinafter referred to as TRD/s) Obtaining PASSPORT, VISAS &/o any other documents &/o permission to travel shall be the sole responsibility of the PAX/s. SIV may only assist PAX/s in acquiring &/o obtaining the necessary TRD/s as per the laws of the land. SIV shall neither be responsible for any delay &/o refusal of entries/exits to/from the countries visited on the tour nor shall entertain any claims from any PAX/s in respect of any lacuna in TRD/s.
4. INSURANCE : SIV recommends that all PAX/s undertake suitable Overseas Medi-claim Policy and Holiday Insurance Cover. Please note that in some countries it is mandatory to have them. SIV will assist PAX/s for recovery of expenses if and only if the policy is issued through SIV.
5. TRS Bookings :
A. Tours :
I. The PAX/s after going through various BR/s &/o Quotes (for brevity’s sake hereinafter referred to as QT/s) and the attached conditions shall choose such TRS as the one most suitable.
II. Due to circumstances beyond the control of TOP/s &/o SP/s &/o SIV, the Itinerary for the local &/o any sight seeing tours is liable to change/vary/alter or be cancelled without any prior notice.
III. For all Pre-Set tours based on published BR/s offered by other TOP/s booked through SIV, SIV shall not be responsible for any change in the Itinerary &/or the tour arranged by the TOP/s &/o SP/s.
B. HOTELS/ACCOMMODATION : (for brevity’s sake hereinafter referred to as HTLS/ACMD)
I. All rates for booking/s (for brevity’s sake hereinafter referred to as BKG/s) HTLS/ACMD unless specified otherwise in the BR/s &/o the QT/s).
II. All BKG/s &/o QT/s are subject to availability &/o revised tariffs &/o changes in terms and conditions without any prior notice.
III. QT/s do not include taxes, service charges, porterage, tips etc unless specified otherwise in the BR/s &/o the QT/s.
IV. Any increase in Tax rates shall be added as applicable and shall not form a part of the QT/s.
V. The types of HTLS/ACMD shall be arranged as specified in the BR/s &/o the QT/s.
VI. If the desired / required HTLS/ACMD is not available, alternate will be reserved at the sole discretion of SIV &/o TOP/s unless specified otherwise by the PAX/s.
VII. If the alternate HTLS/ACMD reserved is not acceptable, the PAX/s shall inform SIV in writing immediately, failing which PAX/s shall be liable to pay ‘no show charges’.
VIII. Normal check-in time at HTLS/ACMD is 1400 hours. However, it may vary with different HTLS/ACMD. If the PAX/s is/are arriving earlier the HTLS/ACMD should be reserved from the previous night/day and shall be charged accordingly.
IX. Normal check-out time from the HTLS/ACMD is 1200 hours. If any PAX/s intends to check out late, the HTLS/ACMD is liable to recover additional rate directly from the PAX/s.
X. SIV &/o TOP/s &/o SP/s shall not be responsible or liable in case of any theft &/o robbery &/o loss of any item belonging to PAX/s from HTLS/ACMD at any point of time.
6. MODES OF TRAVEL :
Transfers : Airport HTLS/ACMD transfers &/o to places of sight seeing, etc will be provided as per the BR/s &/o the QT/s on SIT-IN-COACH basis (for brevity’s sake hereinafter referred to as SIC) unless specified otherwise.
A. Air Travel: Seats will be booked as per the BR/s &/o the QT/s on the lowest possible fare available in economy class unless specified otherwise by the PAX/s.
B. Bus / Coach :
I. SIV &/o the TOP/s &/o the SP/s usually use air conditioned / air cooled Luxury Coaches unless specified otherwise in BR/s &/o the QT/s &/o requested otherwise by the PAX/s.
II. SIV has found it fair to daily rotate the PAX/s seating arrangements in the Bus/Coach, hence no seat numbers are pre-allotted.
III. For all bus / coach travel during the tour, the average travel time may be approximately 8 hours a day. The coaches are equipped with an emergency washroom. However this facility should be sparingly used as there are frequent comfort stops.
IV. PAX/s is/are advised not to leave behind any high value items in the bus/coach. SIV &/o TOP/s &/o SP/s shall not be responsible or liable in case of any theft &/o robbery &/o loss of any item belonging to PAX/s from Bus/Coach at any point of time.
C. Car / Mini Van :
I. Self Driven &/o Chauffer Driven Private vehicle shall be booked as per request from the PAX/s.
II. In case of BKG a self-driven car/vehicle, it is mandatory for the PAX/s to have a valid Driving Permit &/o International Driving Permit and a valid International Credit / Debit Card.
III. The type of vehicle rented will co-relate with the tariff/QT/s for rentals.
IV. If the desired/required car/vehicle/mode of transport is not available, alternate will be reserved at the sole discretion of SIV &/o TOP/s &/o SP/s unless specified otherwise by the PAX/s.
V. If alternate car/vehicle/mode of transport reserved is not acceptable, the PAX/s shall inform SIV in writing immediately failing which PAX/s will be liable to pay ‘no show charges’.
VI. In the event of any breakdown of any gadget, machinery or vehicle, SIV shall not be responsible in any manner whatsoever and no claims for compensation shall be entertained by SIV.
D. Railway : BKG/s shall be made as per the Itinerary in the BR/s &/o QT/s on the lowest fare unless specified otherwise by the PAX/s.
E. Cruises : Cruises shall be organized as per the Itinerary in the BR/s &/o QT/s in inside cabin unless specified otherwise by the PAX/s.
7) MEALS : The types of meals included are clearly indicated in the BR/s &/o QT/s (i.e. breakfast, lunch, dinner etc.).
I. Every effort will be made to provide special meals on request from PAX/s. However, SIV can neither guarantee this nor will it entertain any claim for not providing the same.
II. SIV however, reserves the right to change the meal arrangement if circumstances make it necessary to do so.
III. If the PAX/s do not like the meals &/o miss any meal offered in the BR/s &/o the QT/s for any reason whatsoever, no claim for compensation shall be entertained by SIV. SIV &/o TOP/s &/o SP/s is/are not responsible if the meals provided are not to the PAX/s liking in the airplane, cruise, restaurants &/o any place during the Tour.
8) VOUCHERS : Upon full payment towards the entire Package Cost, the PAX/s will receive a voucher for their selected Tour Programme. The voucher serves both as a confirmation and an exchange document for availing any of the TRS Booked. It is essential that the PAX/s carry this voucher with them for exchange with the TOP/s &/o SP/s upon arrival at the destination.
9) PAYMENTS :
I. Non-refundable deposit of US $500/- per person is required along with the BKG/s. This shall be adjusted against the cost of final tour. However SIV reserves the right to increase this depending on the type of Tour selected.
II. If and as & when air ticket/s is/are required to be issued, the PAX/s will have to make full payment for the tour package before issue of the air ticket/s.
III. All payments for BKG/s TRS shall be as filled in the booking form overleaf. No confirmation or exchange document will be issued unless the full payment is received before the departure,
10) CANCELLATIONS FEES : (Subject to the services being refundable)
On cancellation of BKG/s &/o on Non-Payment of balance amount, 100% deposit will be confiscated and PAX/s shall have to pay additionally :
I. 25% of the total cost if tour is cancelled 21 days or more prior to departure.
II. 75% of total cost if tour is cancelled 20-15 days prior to the departure.
III. 100% of the total cost if tour is cancelled 14-01 days prior to departure or in case of No Show.
IV. Cancellation Rules of SP/s vary from one SP/s to another and the PAX/s will be liable to pay the same, as charged by SP/s.
11) COMPLAINTS :
SIV shall not entertain any complaint, dispute etc. unless received in writing from the PAX/s within a period of 30 days from the date of the conclusion of the tour. If the PAX/s has not traveled, SIV shall be informed forthwith and in any event not later than 48 hours from the scheduled date of departure of the tour.
12) CLAIMS : For all claims, disputes of whatsoever nature relating to the TRS booked, the courts in the State of New York shall alone have jurisdiction.
13) REFUNDS :
I. No refunds can be processed for partially utilized services and no- shows.
II. In the event that either SIV or TOP/s or any SP/s is unable to provide any of the TRS Booked for any reason whatsoever (except in case of Natural Calamity &/o Circumstances beyond the control of SIV &/o TOP/s &/o SP/s), SIV shall at its own discretion refund a proportionate cost of the tour to the PAX/s without any interest on the same, subject to refunds received from the TOP/s &/o SP/s, and no claims or grievances shall be entertained thereafter in respect of the same.
III. If the PAX/s is/are booked on a particular mode of transport and due to any reason the said mode of transport is over booked and the PAX/s is/are not allowed to board the transport, the PAX/s shall not hold SIV &/o TOP/s responsible for the same and no claim whatsoever from PAX/s shall be entertained by SIV &/o TOP/s.
14) CONSUMER DISCLOSURE NOTICE :
SIV has contracted with independent TOP/s, Agents, SP/s to provide various TRS in form of different types of TRS &/o Package Tour/s &/o otherwise. SIV takes care to select &/o arrange the services/facilities for the PAX/s holidays, but because SIV only selects and inspects them and has no control in running the same, SIV is not responsible for :
I. Any loss or damage arising from or connected with any TRS irrespective of the manner in which loss or damage is caused;
II. Any negligent acts of commission or omission of any TOP/s &/o SP/s, theirs agents, servants or representatives;
III. Any deficiency of service on part of the TOP/s & SP/s;
IV. Any injury, death, loss or damage caused &/o arising outside the normal selection and inspection process or by the act or default of the management or employees of any TOP/s &/o SP/s who are the company’s independent contractors providing TRS;
V. The delay or deficiency in services provided by any TOP/s &/o SP/s &/o any act or actions of co-travelers, co-passengers who may or may not be availing any of the TRS through SIV;
VI. Losses and additional expenses due to delay or changes in air, train, cruises or any other mode of transport;
VII. Any damage caused to the PAX/s due to reason beyond the control of SIV (force majeure);
VIII. Any temporary or permanent loss or damage to baggage or personal effects however caused.
GENERAL CONDITIONS
I. All tour departures, Itineraries and prices are subject to change without prior notice as these are based on current schedules, exchange rates of transport &/o SP/s etc.. In case of any increase, the PAX/s shall have to pay the difference.
II. Only SIV, in writing, has the authority to vary, add, amplify or waive any stipulation, representation form of condition set forth in the BR/s or the QT/s.
III. It shall be the responsibility of the PAX/s to ensure that they are ready well in time to assemble before the scheduled departure. SIV &/o TOP/s &/o SP/s shall not be responsible if the PAX/s miss the bus, coach, train, ship etc. due to any reason whatsoever. It will be the sole responsibility of the PAX/s to arrive at the next destination and at the time specified as in the BR/S &/o as specified in Itinerary.
IV. PAX/s are advised to take out adequate international mediclaim &/o holiday insurance from their Travel Insurers.
V. SIV &/o TOP/s shall not be responsible for any claims made against them for any delay caused due to any breakdowns, reasons beyond control, acts of nature etc. or due to negligence of PAX/s or for any reason whatsoever.
VI. SIV shall not be responsible in the event of any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss &/o damage or any kind of theft howsoever caused.
VII. All baggage and personal effects at all times and under all circumstances shall be the sole responsibility of the owners &/o PAX/s.
VIII. All bookings are subject to availability.
IX. It is the responsibility the PAX/s to check all TRS bookings, the TRD/s, the time of departures/arrivals etc. before embarking on the journey. SIV takes no responsibility for any errors in understanding by the PAX/s.
X. The PAX/s shall point out error in bookings by SIV within 24 hours of delivery of the TRD/s. In the event of any failure to point out the error, the consequential results shall be borne by the PAX/s.
XI. Any rectification, change or correction shall be made in the TRS arrangements by SIV by levying additional charges.
XII. All tour departures, itineraries & prices are subject to regulations of the Law of the Land.
XIII. Tour Cost excludes any extra expenses due to climate, land slides, snow fall, health problems, hospitalization, extra transport due to illness, porterage, tips or any kind of expenses of personal nature.

LIMITED LIABILITY CLAUSE
The liability of SIV shall be limited to a maximum of 4% of the Tour Cost &/o US $250 whichever is less. It is hereby declared that the immunities
provided under this contract shall be available to the management of SIV Managers, Representatives, Employees, Servants and Agents.

Disclaimer Notice:
Although every effort is made to ensure accuracy, all airfares and prices quoted these are subject to change without prior notice, conditional to airfare increases and rate of exchange fluctuation. Once documents have been issued and in certain cases if bookings are cancelled or changed, cancellation or change penalties could apply.
SANS Incredible Vacations acts on behalf of all suppliers/tour operators of hotels, airlines, car hire companies etc. and as such cannot be held liable for any unforeseen increases, changes, damages.
The receipt of these terms and conditions signifies your agreement to indemnify and hold harmless the company, its employees and agents for any personal injury, loss, disease, damage or expenses of whatsoever nature and howsoever arising, which you may sustain or incur by reason of any act or omission on the part or the company, its employees or agents. No variation or alteration hereto shall be of any force or effect unless consented to in writing by SANS Incredible Vacations and signed by you and SaNS Incredible Vacations.
